Booking your holiday at Lakeview

Booking Terms

Please read this carefully. When you book your holiday with us you are entering into a contract which binds you and us in various ways. You'll see that we have clearly set out the booking conditions with a list of responsibilities and commitments we and you have towards each other.

1. Terms

All terms are either per week or per short break (start day as specified) for the accommodation as equipped and described. Your property will be available for occupation at 4.30pm (subject to unavoidable delays). You must leave your accommodation by the time stated on your hire invoice (usually 10am). You are obliged to leave everything in a clean and tidy condition. Prices include VAT (where applicable). We reserve the right to correct errors in advertised prices. We will advise you of any error at the time of booking.
We also reserve the right to correct errors in confirmed prices; in this case, we will contact you as soon as we become aware of the error. If the correct price is higher and you do not wish to pay this, you will be entitled to cancel and receive a full refund of all monies you have paid to us providing you notify us within 14 days of our advising you of the error. We promise we will not seek to correct any error in a confirmed price within 8 weeks of the start of your holiday or more than 7 days .after you make your booking.
For holidays of 7 days or more, starting Sunday, Monday or Tuesday, the previous Saturday charges apply; for Wednesday Thursday or Friday charges the following Saturday charges apply.
For 3 or 4 night Breaks that cover two price periods, the week in which the greater number of nights are taken applies. Where an equal number of nights are taken in two different price periods, the average of the two weekly prices applies.

2. Booking Confirmation

A binding contract between us will come into existence when we issue a hire invoice and booking acceptance. The contract shall be deemed to have been made at our offices in Atlantic Reach and be subject to English Law. Both parties agree to submit any dispute to the exclusive jurisdiction of the Courts of England and Wales. In all cases these Conditions of Hire form the basis of your contract.

3. Number in your party

It is a condition of your booking that the total number in your party shall not exceed the capacity of the accommodation as advertised in our brochure. Babies under 2 are to be counted as members of your party.

4. Booking Monies

When you book you must pay a minimum of 25% of the balance of the booking monies as a deposit. The outstanding balance of your booking monies is due and payable 6 weeks before your holiday start date. Where the booking is made within 6 weeks of your holiday start date the full balance of the booking monies is due and payable when making your booking. We reserve the right to pass on to you any bank charges and other costs we incur if payment is made in a foreign currency, by any other method not normally accepted by us or if we have to re-present a cheque or process late payments.
The prices shown in the brochure are cash prices only. Where you choose to pay by credit card we will make a charge of 2% in respect of each payment by credit card. This charge does not apply to payments made by debit card.

5. Alterations by hirer

Once the hirer has received written confirmation (email will qualify as written confirmation) of receipt of the initial payment of booking monies (as defined above) any request by the client that the booking be amended or re-invoiced for any reason will be subject to an administration fee of £20.00. For the purposes of this clause written confirmation includes confirmation received by email. Where a booking is made outside the period of 6 weeks before your holiday start date you may change your accommodation to another accommodation at the same park as your original booking, subject to availability, payment of the above fee and any then outstanding difference in price. You may transfer your booking to another party (introduced by you) at any time providing you pay the administration fee of £20.00 and any then outstanding balance.

6. Cancellation Booking Insurance

You are strongly recommended to take out our Cancellation Booking Insurance for your holiday.

7. Cancellation by hirer (where booking is not covered by our Cancellation Insurance)

It is the responsibility of the client to telephone immediately the park where their holiday is booked if they have to cancel the holiday. The hirer must also, on the same day, post to the park, by first class mail, their Hire Invoice along with a letter advising that they wish to cancel. The cancellation is active from the date the park receives the written notification. The cancellation will be acknowledged by the park in writing. Cancellation can be made at any time, subject to the following charges.

Any amount held back can be used against a further holiday with Cornish Country Club Resorts within a 12 month period from the date of your cancellation letter. If the new holiday is less than the amount held you will not be entitled to any refund of monies.
All of the liabilities as stated may be covered if you have purchased our Cancellation Insurance.

8. Minors

We cannot accept bookings from anyone less than 18 years of age.

9. Linen and Towels

Bed linen is provided (this will be duvets and sheets). Towels are not provided unless in a premier lodge at Lakeview Country Club. Any request to supply towels in any other accommodation will be subject to a charge of £8.00 per person (2 towels per payment).

10. Availability

Your booking is accepted on the understanding that your confirmed accommodation will be available for your use on the agreed date. Very occasionally, "force majeure" does not make this possible. Where "force majeure" (as defined in clause 11) arises, we have the right to cancel your booking. In this event, we will endeavour to offer you an alternative accommodation, if available. If we cannot do so or if you do not wish to accept the alternative we offer, we will refund all monies you have paid to us in full. Where any cancellation or change results from "force majeure" as defined in clause 10, our liabilities are limited to offering you an alternative property (where available) or full refund as set out above. We regret we cannot pay any compensation or meet any expenses or costs you may incur as a result of any such cancellation or change.
We reserve the right to alter or withdraw amenities or facilities or the whole or any part of any programme of activities, which have either been advertised or previously available, without prior notice, where reasonably necessary due to repairs, maintenance, weather conditions and circumstances beyond our control. The opening and closing dates of facilities are displayed on our website. Opening times may be limited outside the main holiday season.
We have the right to refuse to hand over accommodation to any person(s) who, in our reasonable opinion is not suitable to take charge of it. In such cases, all hire charges paid will be refunded in full, the contract shall be terminated and we will not have any further liability.
If in the reasonable opinion of the park management any person(s) shall be considered not suitable to continue the holiday because of unreasonable behaviour, damage to property or danger or significant annoyance to others, the contract may be terminated. In such circumstances Cornish Country Club Resorts will have no further liability. In this event, you will remain liable to pay the hire price and no refund shall be due.
Access to the accommodation by Cornish Country Club Resorts. We have the right to enter any accommodation without prior notice if this is practical or possible if special circumstances or emergencies arise (for example if repairs need to be carried out).
Group/Party Bookings. The organiser or leader of a group or party booking is responsible for completing the party details on the booking form. Should you arrive with such group without notifying as of the required details, we have the right to refuse to hand over the accommodation to you.
Single-sex group bookings. We cater primarily for family holidays but sometimes allow single-sex groups and groups of under-21 year olds. Such bookings will only be accepted once approved by the Bookings Manager of the site. The organizer/leader of such group bookings is responsible for the behaviour of the rest of the party. Such bookings may be subject to an additional/alternative Security Deposit (see clause 15).
Wheelchair Friendly Accommodation. Please check with the park for availability of this.

11. Force Majeure

Cornish Country Club Resorts will not accept responsibility or pay any compensation where the performance or prompt performance of our contract with you is prevented or affected by reason of circumstances which amount to "force majeure". Circumstances amounting to "force majeure" include any event which we could not, even with all due care, foresee or avoid. Such circumstances include the destruction or damage of your accommodation (which cannot reasonably be remedied to a satisfactory standard before the start of your holiday) through fire, flood, explosion, storm or other weather damage, break-in, criminal damage or any similar event beyond our control. Such circumstances also include riots or civil strife, industrial action, natural or nuclear disaster, fire, adverse weather conditions, war or threat of war, actual or threatened terrorist activity and all similar situations beyond our control.

12. Your Pet

Two of Cornish Country Club Resort's sites have a limited availability of Pet Friendly accommodation. A charge will be made for bringing your pet. Please check when booking for availability, the charge and the type of pet we accept. There is no charge for guide or hearing dogs. You must tell us that you are bringing your pet when you make your booking. You must bring your pet basket with you. All pets are allowed on the clear understanding, that in no circumstances may they lie on the bedding or chairs. Pets are not to be left unattended in accommodation or elsewhere. Pets are not allowed in the central complex areas, clubs, shops, bars or swimming pool areas. When you exercise your pet it must be on a lead and in the charge of an adult. Pet owners are responsible for cleaning up after their pet and a fine will be levied against anyone found to be in breach of this requirement. In the interest of visitors' safety, and following government legislation, we are sorry we are unable to accept the following types of dog: American Pit Bull Terrier. Japanese Tosa. Fila Brasileiro and Dogo Argentino even where these types of dog are muzzled as required by government legislation.

13. Your Vehicles

Your vehicles and their accessories and contents are left entirely at your risk at all times. We will not be responsible for any loss or damage from or to any vehicle from any cause whatsoever other than, in the case of our negligence of employees or agents or, in our case, negligence of ourselves or our employees or agents. Parking and other regulations may vary from time to time.

14. Liability

Except where otherwise specified in these Conditions of Hire neither Cornish Country Club Resorts or its managers, can accept liability for any damage, expense, injury, death or loss of any nature whatsoever suffered by any person(s) from any cause whatsoever other than, in the case of the park manager(s) the proven negligence of him/herself or his/her employees or agents, the proven negligence of Cornish Country Club Resorts or our employees or agents. This clause does not attempt to exclude negligence or breach of statutory duty.

15. Any Shortcomings

You must notify any shortcomings with your accommodation to the Park representative immediately so that remedial action, if appropriate, can be taken. If a significant problem is not resolved to your satisfaction, please contact the park manager as soon as possible during your holiday. For all complaints and claims which do not involve personal injury, illness or death, we regret that we cannot accept liability if you fail to notify the park manager or his/her representative of any complaint during your holiday and write to us with full details within 14 days of the end of your holiday.

16. Security Deposit

It is the responsibility of the hirer to make good any damage done or loss sustained in relation to their accommodation during their stay. During the checking in procedure it shall be the responsibility of the hirer, or a person nominated by him/her, to provide the park with details of a Credit/Debit card as a form of security. It is the responsibility of Cornish Country Club Resorts to keep said details secure, and destroy them no less than 14 days after the property has been vacated at the end of the holiday.
Cornish County Club Resorts reserve the right to request an additional/alternative Security Deposit where they consider such action necessary.

17. Data Protection Policy

In order to process your booking and to ensure that your arrangements run smoothly and meet your requirements, we need to use the information you provide such as name, address, any special needs etc. We take full responsibility for ensuring that proper security measures are in place to protect your information. The information may also be provided to security or credit checking companies, public authorities such as customs/immigration if required by them or as required by law.

18. Management Rights

The management reserves the right to ask any person(s) to leave the resort at the management's discretion without any prior warning or reasons given. If this happens said person(s) will lose all rights to refunds and will be liable to the full cost of the holiday.
